Introduction

AM Visuals ("we", "us", "our") is a Sydney-based corporate video production company operating at amvisuals.com.au. We take your privacy seriously and are committed to handling your personal information responsibly, transparently, and in accordance with your reasonable expectations.

This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, and the choices you have regarding your data. It applies to all information collected through our website, through any enquiry or booking you make with us, and through any ongoing client engagement.

Australia's primary privacy legislation is the Privacy Act 1988 (Cth), which establishes the 13 Australian Privacy Principles (APPs) governing how organisations handle personal information. The Act was most recently amended by the Privacy and Other Legislation Amendment Act 2024, which received Royal Assent on 10 December 2024 and introduced stronger enforcement, new transparency obligations, and a statutory tort for serious privacy invasions (effective June 2025).

While the Privacy Act formally applies to businesses with an annual turnover above $3 million AUD, AM Visuals voluntarily elects to comply with the Australian Privacy Principles as a matter of good practice and respect for the people we work with. We believe you deserve the same protections regardless of whether they are legally required of us.

We will never sell your personal information to third parties. That is not something we do, have ever done, or will ever do.

Information We Collect

We collect personal information only when it is reasonably necessary for our business functions. The types of information we may collect include the following.

Contact Information

Your name, email address, phone number, and company name. This is collected when you submit an enquiry, fill in a contact form, book a call, or get in touch with us by any means.

Usage and Analytics Data

Information about how you interact with our website, including pages visited, time spent on each page, referring URLs, device type, browser type, and IP address. This is collected anonymously through cookies and third-party analytics tools including Google Analytics.

Project and Business Information

When you engage us for a video production project, we may collect additional details including your business objectives, target audience, budget, brand guidelines, and any creative briefs or materials you share with us to complete the project.

Communications

Any correspondence you send us including emails, phone call records, and messages through our contact forms or booking system. We retain these to maintain a record of our relationship and to deliver the services you have requested.

Payment Information

Where applicable, billing details such as your business name, address, and invoicing contact. We do not store credit card or banking details directly. Payments are processed through secure third-party payment providers.

Marketing Preferences

If you have opted in to receive marketing communications from us, we retain your contact details and communication preferences so we can send you relevant content, offers, and updates.

We collect most of this information directly from you. In some cases we may receive information about you from third parties, such as referral partners or publicly available business directories, but only where this is relevant to providing our services.

How We Use Your Information

  • To respond promptly to your enquiries, quote requests, and questions about our services.
  • To prepare and deliver video production proposals, creative briefs, and project scopes tailored to your business.
  • To fulfil our contractual obligations and deliver the video production services you have engaged us for.

  • To process invoices and manage billing for completed work.

Every marketing email we send will include a clear, functional unsubscribe option and we will action opt-out requests promptly.
  • To comply with our legal obligations under Australian law.

We only use your information for the purposes you provided it for. We will not use your project details, business information, or contact information for any purpose unrelated to delivering our services or maintaining our relationship with you.

We treat your personal information with discretion. We do not sell, rent, or trade your information with anyone. We will not share your personal information with any third party without your consent, except in the following limited circumstances:

  • Service providers. We work with trusted third-party providers to help us run our business. Despite our best efforts, no method of data transmission over the internet or electronic storage is 100% secure. While we work hard to protect your data, we cannot guarantee absolute security. The Notifiable Data Breaches (NDB) scheme under the Privacy Act formally applies to organisations covered by the Act (generally those with turnover above $3 million AUD). As a matter of voluntary best practice, AM Visuals commits to the same standard: in the event of a data breach that is likely to result in serious harm to any individual, we will notify affected individuals and, where appropriate, the Office of the Australian Information Commissioner (OAIC).

Your Rights

In line with the Australian Privacy Principles, and as a matter of our voluntary commitment to best practice, you have the following rights in relation to your personal information:

  • Access. Under APP 12, you have the right to request access to the personal information we hold about you. We will respond within a reasonable period, generally within 30 days. We will not charge an excessive fee for access requests and in most cases will provide access at no cost.
  • Correction. Under APP 13, if you believe information we hold about you is inaccurate, out of date, incomplete, or misleading, you have the right to request a correction. We will take reasonable steps to action your request promptly.
  • Request deletion or de-identification. While the Australian Privacy Act does not provide an absolute right to erasure (unlike the EU's GDPR), we will take reasonable steps to delete or de-identify personal information we no longer need for any lawful purpose, upon your request, unless we are legally required to retain it.
  • Opt out of marketing. In accordance with the Spam Act 2003, you can withdraw consent for marketing communications at any time using the unsubscribe link in any email, or by contacting us directly. We will process opt-out requests immediately.
  • Make a complaint. You may lodge a complaint with us if you believe we have mishandled your personal information. If you are unsatisfied with our response, you may escalate to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au. Note that from June 2025, the Privacy and Other Legislation Amendment Act 2024 provides individuals with a statutory tort for serious privacy invasions, which may be actionable in court.
